When parties have shared parental responsibility in accordance with an order, they are required to make decisions jointly in relation to major long term issues of the child/children.

This requires each of them to consult each other and make a genuine effort to make decisions about the care, welfare, and development of the child/children of a long term nature.

Those decisions include matters such as the child’s education (current and future), religious and cultural upbringing, health, name, and changes to the child’s living arrangements that make it significantly more difficult for the child to spend time with a parent.

There is a presumption of equal shared parental responsibility when making a parenting order but this does not apply in certain circumstances or may be rebutted if it is not in the child’s best interests.
